Title IX
Title IX of the Education Amendments of 1972 prohibits discrimination on the basis
of sex in education programs and activities that receive federal financial assistance.
Under the Title IX regulations, sexual harassment may include sexual assault, dating
violence, domestic violence, and stalking.
Edmonds College must apply specific jurisdictional requirements to determine whether reported conduct falls within Title IX. Conduct that does not meet the requirements for a formal Title IX complaint may still be addressed under other College policies and procedures.
When the College receives a report of sexual harassment, supportive measures are available to complainants regardless of whether a formal complaint is filed. Supportive measures may also be available to respondents. A formal complaint initiates the Title IX grievance process when the allegations fall within the scope of Title IX.
The Title IX grievance process includes an investigation, a live hearing, questioning of the parties and witnesses through advisors, a determination by an impartial decision-maker, and an opportunity to appeal. Complainants and respondents may have an advisor of their choice throughout the process. If a party does not have an advisor for the live hearing, the College will provide an advisor without fee or charge for purposes of conducting questioning at the hearing.
In appropriate circumstances, the Title IX regulations also allow the parties to voluntarily participate in an informal resolution process instead of completing the formal grievance process.
The College is committed to administering its process in a manner that is fair, transparent, and consistent with applicable law. In addition to Title IX, the College must comply with other federal and state requirements, including the Violence Against Women Act (VAWA) and the Clery Act, which establish additional requirements related to sexual assault, dating violence, domestic violence, and stalking.
